The Supreme Court has issued a verdict in the Jabra Fan case, ruling in favor of Yash Raj Films. The legal battle, which centered around the song ‘Jabra Fan’ from the film ‘Fan,’ has finally reached a conclusion with the apex court’s decision. Yash Raj Films emerged victorious in the case, securing a favorable ruling from the Supreme Court. The decision comes after a prolonged legal dispute surrounding the song’s rights and ownership.
The song “Jabra Fan” was left out of the Shah Rukh Khan film Fan, but the Supreme Court of India decided in favor of Yash Raj Films (YRF). This decision overturns a 2021 National Consumer Disputes Redressal Commission (NCDRC) rule that had mandated YRF compensate a moviegoer who felt mislead by the song’s omission from the film by Rs 10,000.Afreen Fatima Zaidi submitted a complaint that led to the case, claiming that after seeing ‘Jabra Fan’ advertised in trailers, she and her kids were dissatisfied when it was left out of the film. Zaidi had stated that her children’s health problems were a result of this disappointment.
At first, the NCDRC had taken Zaidi’s side, arguing that the promotional strategy violated the Consumer Protection Act as an unfair trading practice.
But YRF appealed this ruling all the way to the Supreme Court, claiming that “Jabra Fan” was only a promotional song and wasn’t required to be in the finished movie. In the end, a Supreme Court bench composed of Justices P.S. Narasimha and Aravind Kumar supported YRF’s position. The line between promotional information and the finished cinematic product is made clearer by the court’s ruling.
